Firearms-this will be interesting

This just popped up on the news.

Stake Hill aggravated home burglary: Naked man shot in wardrobe after alleged home invasion | PerthNow

I have little doubt there will be consequences short or long term for the home owner.

Interesting to me as last friday night at my house, at midnight on a friday following a few noisy partys in my suburb there was a commotion on the street and a 16yr old kid came sprinting to our front door and inside.

He was panting and on the phone to the police and said some kids were fighting around the corner and had been chasing him with a knife.

I had already spoken to the cops as there had been another incident probably related about 20 min before.

Both calls gave my address.

1/2 hr later the kids sister picked him up.

The police never turned up at, passed by or anything astonishingly but it raised the question to me of what if those kids chased him into my house with knives?

There have been numerous incidences in WA and interstate of people defending themselves with a firearm and then having to go to court to defend that or get their firearms returned.

I'd be astonished if the incident below didnt proceed similar, first with his firearms being seized.

That's the magic phrase I'm led to believe.  State you are in fear of your life and all bets are off (well, within reason obvioulsy).  Pretty sure it only applies to the home invasion type scenario, not just in general life

 Catch a little theif in my house and they are going out of town "crabbing" no phones taken and they won't be doing it again, Got a lot of mates with the same attitude at the moment. Pretty much sick of the shit and the government aren't listening, all they are doing is threatening law abiding citizens with alcohol restrictions and not sorting the issue out about who is accountable for these little neanderthals .Waste of time calling the police because they are over the shit as well.

 In the current climate I won't be surprised if they go after the firearms owner and charge him. After what happened to Ron sterett in the NT who was charged after his neighbour was stabbed. Papalia wont let an opportunity like this slip by. Hope I'm wrong but have zero faith or trust in this government and police minister/dictator 

Just a foot note, these pages relating to anything firearms are being monitored by WAPOL so if you own firearms be very careful in what you say. Under the proposed new laws they can take your firearms away based on your views attitudes and opinions and you have no right of appeal so just be careful but not silenced

 Must admit i would never post anything about firearm use on any forum/online. Just leaving yourself open to someone that "maybe" monitoring.

On another note, about self defence in your own dwelling !!!

I think you can only use "reasonable" force. IE is if he has a knife according to those words you can only use like for like.

EG if an intruder is unarmed and he was to be flogged with a baseball bat, the home owner will be charged. Crap laws but laws aren't used these days for the law abiding citizen.

Bill Collector - I believe you are Broome based, i am 35 years Kununurra and have seen a massive change for the worse. I don't use Facebook but most of the breakins are reported there.

Last week a young female tax paying individual had her car stolen and burnt. The kids are not just happy joy riding but like to inconvienence as much as possible.

 Broome based for now but not for much longer, Waiting for the Fitzroy to slow down and fish hard in late April. Then heading south. Burning the cars has slowed down here a bit due to a change in the rules about what remains on a record once the little darlings turn 18 but it hasen't stopped them trashing the vehicle. 25 years here and the difference between when we arrived and now is massive.

Too many self interested organisations happy to get funding but not directing it where it needs to be spent, and too many parents that don't give a shit what their little darlings are doing because they are wasted on whatever is the flavour of the month drug and booze wise.

 As far as I know you can never use a firearm for self defence (the last line of defence for a copper too , words, pepper spray, tazer then gun , no one wants to pull out their service pistol), pretty sure it is written in the laws like that. (I have owned guns here in WA since I was 18 (42 yrs) and since I was 10 in South Australia (just an air rifle in SA, 6 yrs)

 

EVERY one I taught how to shoot a pistol in the 4 years I done it for the club I was in,,,, I emphasised the gun is for use at the club and the club only, even if you wanted to go to another club you had to get an invitation from the other clubs committee, only 3 places you can legally take a club use gun for it / them, is the cops, a gun store or a club thats it, and straight to and from there too.  (or a property if a rifle / shotgun, on a property letter).

I got rid of the 6 pistols I had (.22 to .44mag) , my club pissed me around so me and my son left it, clubs are a law unto themselves, only way to complain is to the police if its about something lawfull / criminal or you take them to court if its civil, they have no oversight , they do what they want.

I have my range officers card for 8 disciplines, my saferty officers card and I have also done a range development officers course as well (so everything from running a club / state / national championship / competition to designing a new range and getting police approval for it) the only thing I never got was to be a coach as SSAAWA didn't do that.

If you use a gun you will either be carried by 6 or judged by 12.

At least 10 years before you can own a gun again if you get them taken off you for doing something silly.  (,,I know of people that have, & are still trying after 20 yrs)

But even that story has the Detective saying "we can't say at this stage if any charges will be laid".

Which means you'd be wise to have legal representation and significantly out of pocket already.

 Depends I guess but I'd say its much easier to avoid getting charged than to have charges dropped so you'd be wise to get advice prior.

SSAA or National Shooting Council likely provide this initially if a member.

Just like Fisheries, they would lose face if backing down after proceeding so will do anything to avoid that.

I pull a pot and there's 30 crays I've got 5 minutes to sort them, what's the difference as per Carter with his catch bag. It seems as the article says the only thing holding up here is common sense by fisheries since.

Every case is different I guess and can be a long drawn out process in the end.I know someone doing life in jail for popping their partner,long term domestic violence and was physically assaulted just before they fired the shot.It will take a lot more than a few words to justify the action and bring the judge / jury around to your corner

Who ever was / is getting abused ( phisical or emotionally) needs to get an AVO pronto. 40 plus years as an owner and I have never ever thought of a gun as a weapon.

 

I have allways thought an AVO means that the police removes any gun(s) licensed to either party and then sends them off for a long rest well away from the situation.

 

I don't know what I would do if there was a naked man in my daughters bedroom tho ???? my 6 cell mag light might get used to illuminate that the person is not welcome in my house (my Rottweilers would probably like a word or two with him as well) A watch dog barks and a gaurd dog bites, I like to think my dogs are more the gaurd dog variety, 2 X 60kg dogs will make anyone think my place is not worth visiting. 

If this rock crab is still in the world of the living then I am pretty sure the inmates at the prison will give him a loving welcome for however long he is there. (jmho)
