Who has the final say!
I'm taLking weather and "Who has the final say" on a Fishing Charter boat. So, i'd like your thoughts re this;
* Do you get told the "night before" your charter that the weathers average and its up to you, do you want to cancel or do you get told "its canceled"?
(2) Do you get told that morning "just before" your charter that the weathers average and its up to you, do you want to cancel or do you get told "its canceled"?
(3) Despite you being keen and the Charter company knows its going to be shit weather/bugger all fish will be caught would you be happy for them to make the "final decission" despite you not liking it?
My take, I used to work on Fishing charter boats and one thing that i used to see and still see at the present is disturbing. Knowing the winds are average,the chances of catching fish are low and the rate of sea-sickness will increase i dont beleive leaving that decission to them is right. Especially when they dont "work" on the water or have a full understanding so leaving it up to them re to "go or stay" doesnt sit well!

Okay I'll get ya thoughts Dean. So, if the Charter Company said "look mate its crap out there do ya wanna go" WOULD you be pissed off that you werent told that last night or say you did go and it was absolutely CRAP ie bad weather/no fish etc would you Blame them/reflect on the Charter Company/person?

Yeah I would be pissed if I drove down there and it was cancled instead of being told the night before. especially when I can look on the web and see that it is looking dodgy.
I think if the weather is bad, you need to tell the customer that the conditions aren't the best and it will make fishing difficult.

Okay, after telling them the fishing will be difficult they said bugger it we wanna go, does the client have the final say? and if the day turns to poo ie fishing & weather wise.....does some one get the blame/reflect on repeat clientel?

Nah, you made the customer aware that the fishing will be shit.
But it is your boat and you should have your limits, so if you know the weather is unfishable, you think you will catch bugger all then can it IMO.
Some customers would be happy to anchor around rotto for the day etc.

"Duty of Care".. What if someone got hurt on a pitching deck. What would the insurance company say. They would be the ones I am asking and finding out where you stand. Because they are the ones who will leave you high and dry if they think you should of cancelled.
Other than that the decission should be the skippers. He is responsible for the safety of the passenger at all times. Unfortunately the lure of the dollar rules. Its hard to throw away a charter when the punters insist on going.

i see it that its the skippers job to make the "final say" and make the calls the night before if its unfishable and unsafe to crew and boat ..
but if its just a bad weather day and the crew really want to go .. provided its not unsafe .. then its all systems go.
safety comes first .. if im skippering my boat (or anyone elses) then my word is law . if ppl dont like it then they can swim home next time . if i say its too rough - then it is .. a charter boat should be no diff. .. im also a believer of no go/no pay (or at the least a voucher thats got a 12 month expire)

Depends on whether I have to pay for the trip or not.
If I cancel, it is likely that I'll have to pay - for nothng. If the charter cancels - and they should if the weather is touch-and-go because they have their customers to think of - then it should be at no cost to the client.
Either way, the client can expect to pay for a good days fishing - and that is not saying catching fish, that's the risk of the sport - but the charter should at least povide the best opportunity to catch a fish. That doesn't happen if the weather if 50-50. So, unless a good day fishing is provided, the client shouldn't have to pay.

Just a thought what if its a
strong wind warning, would the skipper take the boat out or is his insurance nul and void? .. somebody said duty of care for him or his paying customers?

Yes agree Noha, the "Duty of Care" is a big thing and i've been on my old charter boat where somone hurt themself and they sued/got the claim!
Agree Andrew, the Skipper "should have the last say" but not from what i've seen/heard. The call "should" be made the night before so no disapointment. Yeh Ody, if the skipper cancels you dont pay but if the boat goes and you dont then you've lost the $$$from what i've seen.
Geoff, talking group & individual. Spot on Roberta, there's insurance & public liability clauses and they wouldnt want to go down that track as the person making the claim would probably win!
** My main reason for asking as mentioned before is seeing/hearing that "its up to them, if they want to go then we'll go"..... knowing to well that the conditions are average and catching fish will be friggen hard **

I think the skipper has the final say, It may be a bit of a bugger driving down to be told your not going ,but who wants to go fishing and get the crap knocked out of ya, and catch no fish .We did a charter from Two Rocks, it got canned twice ,but we did get out two weeks latter ,it was dead flat and we caught a heap of fish well worth the wait.I know when i take freinds out its my call on if we go where we go and if it is choppy or to much tide ,i tend to lose intrest as the skipper ,and i guess this would be the same for the charter guys ,i don't think they are to rapped in bobbing around when its rough, hoping they can get a few fish ..

Spot on Paul, atleast when you got out it was a great day and repeat clientel would follow from such a good trip.....that's what it's all about!
Yeh Fishoreub, if they the charter company canceled you get your $$ back or you can re-book. I agree Noha, the lure of the $$$ keeps charter operaters wanting to push the limits at the clients expense....that i dont agree with!

Ryan I am so with you on this one. I have a fairly iron gut but the mad keen fisho missus does not. Been to Exmouth semi recent and got told it "should be cool". I looked at BOM and thought well maybe. We went out, Gillian layed on the deck all day, it was bloody rough (northerly), going to the Murions, the "deckie" was sick and so was 6 other customers, I with 1 other survivor fished and it was a very suck day. Then the skipper said "that's fishing!!!!"
I do believe that if we pay 100's of $ 4 a charter we do have a right, and if the weather is shit then either they dont go or give us a choice to cancel or not. It is not up to the skipper, it is up to the comfort of the paying customer! Yes the skip may have the final call, but if he thinks the boat will handle it, the paying crew may not!!
Never will I ever pay that S#*t charter again.
