My poor girl
So here she is and she lays in state at the smash repairers awaiting her fate. From an initial look the smash repairer reckons a write off
I've put a lot of extras on her including new suspension that was going to be tested on the Gnaraloo track at the end of the month.
So a couple of parts to this post, firstly as a preemptive I've been out to look at replacement cars and took a V6 8 speed Sportline Amarok for a test run yesterday, well it nearly pulled my face off with the kickdown torque heading onto Roe Highway. With their end of financial year runout deals it's going to be hard to beat at 1.8% finance. She will of course need extras like long range fuel tank, roo bar, well liner and tow ball to start. But the finish of the car is exemplary, good old German engineering.
Ok second part of this post is for anyone with legal mind. So my car was only insured for market value and when I get paid out I reckon I'll be about $7.5k out of pocket for all the extras ( for something that wasn't my fault FFS) Has anyone heard of a precedent of the other party being sued for this?

to be honest, i dont like
to be honest, i dont like your chances about the extras. best bet would be to speak to your insurer and then they deal with the other party about it. also, market value will be a lot less than you would expect.
we had a car written off a few years back by a drunk driver, to replace the car it would have cost about 4k we got 2k from insurance,
not good at all about the car tho. hope you get a replacement before your planned trip

Speak to sunshine.
In the past Ive heard of the insurance company claiming actual value and paying the extra if they get it.
But these days they mostly have the same underwriters so wouldn't happen I reckon
Thinking about it though, you need to speak to your insurance company as when they settle the claim normally it will be full and final payment for the other company and you won't get past that.

They will bend if you got a few things insured with them I have found. I had to threaten them I would change everything over when they wanted to put second hand parts on my clubsport. They told the panel beater that it was over 10years old so just put a second hand front spoiler on it. The panel beater rang me and told me. After a talk with the assessor and his boss the new one was ordered. The car was insured for an agreed value.

Check out club 4x4
They insure your car and then you can cover all your extras on top of that. My ute has market value for 21k and then another 9k in extras that dont depreciate. Might cost a little more than other companies but they cover your vehicle no matter where you are. I found them quite competitive but by far the best cover for your 4wd.

Bugger about the prang, I do know of people who have removed add on's to the car before letting insurance get to it as they won't get them back.

Covered.
I had my Mustang insured but in the deal if it was a wright off, I get to keep the wreck.
Maybe check to see if this is part of yours then you can get another WildTrack & change over the parts. A long shot but maybe worth a look.
Good luck with it all & I hope you get it sorted before the trip north.
Cheers & Stay safe

My Ute was only around $18.5k market value, but I paid for an agreed value of $21k, so if I get into the same as Andy, I hope they pay the agreed amount.

Market value should include
Market value should include the extras - if you were to sell the car this would increase the market value
That said a lot of policies state you need to specify any extras on the policy (so they can determine if this increases risk/premium)
Do you have other policies with the same insurer - if so point this out and tell them iyou prepared to shop around and move the lot. They may bump settlement up to keep you
Specify any extras you have with the new car so they are listed on the policy
-Is they party at fault insured - if so you might be in a better position - your insurer can recover costs or you could try claiming direct against his insurer first

If there is one thing that I
If there is one thing that I have learned with insurers it is that they will pay the least possible amount that they can get away with.
I have found though when you push back and don't accept what they are force feeding you they do bend. You just have to not accept if it's not fair. Keep on going up the chain until you find someone that will talk to you and put your case forward so that you get something for your extras, either additional money or if they won't cover them, then take them back. They can't have it both ways.
its often slow and sometimes requires some pretty direct talking but I have found that it works especially if you are a long term client or have a lot of business with them.
Good luck.

Insure extras
That's a real bugger and no amount of insurance covers the invonvieniece you just got to be glad no one was hurt bad the other car must of looked pretty munted, at least you were not killed by the airbags.
On all our work vehicles we have to list extras to have them covered eg roobars, toolboxes, minespec crap etc.
The tray cover would be worth getting off if you can as well I priced up when looking at a ute and they were not cheap.

It doesn't look
like a write off Andy. Is there more damage to the drivers side? Having said that, if the engine bay is twisted, then it probably is a write off. cheers Pete.

Only needs the slightest
Only needs the slightest movement in the front pillar to be a write off.

Yeah thanks mate, I was feeling a bit crook for a couple of days. And I thankfully the young girls in the other car were too, I don't know how I'd come to terms with severely injuring or even killing a young child like that even though not my fault.

We had our insurance company
We had our insurance company tell us that our little Corolla would be a write-off and they would pay about $2000 as it was insured for market value. We told them to try to find one in similar condition with the same kms for anywhere near that low price. The lowest we could find was $4000. They changed their mind and repaired it.

Check your wording
Hi - I'm an Insurance Broker that specialises in transport. First thing you should do is check your wording - you may have a replacement clause in there in the event of a write off (up to 3 years on some policies). The check check to see if accessories are included in the sum insured or have to listed. If they are not covered, then you should be able to remove them from the salvage as they will not be forming part of the claim.
Just general advice only, I've not taken your personal circumstance into consideration.
PM me if you want a chat.

Thanks Matt, I've also spoken with Gordon (Sunshine) and the market value wording does indeed include extras
Your vehicle is insured for market value. The market value includes all modifications, options and accessories attached to your vehicle at the date of an incident.
So this is promising, should hear in the next day or so of her fate.

Glad no one seriously hurt. Only a pain in the neck from the inconvenience side of things. Here in SA the RAA have good policies which may be replicated over there in the west for your next vehicle if applicable? Here's an excerpt

Thats because they will probably sell it as a repairable writeoff for over $30k, with there liability capped at the circa $17k GAP.
