BEWARE

 Just a heads up.

 

Unfortunately, it appears Fisheries interpretation of the legislation ATM regarding the RBFL and bag limits are not particularly recfisher friendly. Example : If there are 4 fishers on board who catch their bag limits for the day, but mistakenly three of the fishers forgot to renew their licences, the bag limit then shifts to the guy who HAS a licence and he is charged with exceeding his bag limit, even if he has no idea the others Don't have one.

 

F*** knows what the story would be if there were 5 on board, and only 3 have licences. Maybe they divide it up and book all 3 RBFL holders … ?

 

I  understand that if somebody didn’t have a license, then they could only catch under Licence holders (who are on the boat at the time) bag/s  ….. but it’s pretty unfair that if someone is forgetful or whatever, that it becomes the fault of the fishers doing the righty and they cop the fine.

 

Hope all that made sense :P

I was notified by mail that my licence was to expire. Since they have it on record, I would have thought each fisher with an expired licence would be fined, as they new the licences were out of date and required renewing.

Interesting as was listening to 92.9 this morning and the gotchya call they did was almost the same situation. Basically they took the micky out of the skipper, trying to say he may need some re education. Was all a good laugh though.

But the basis of the whole thing was that he was out with a mate and they caught a Dhui each, he still thought it was two per person so within his licence. He was the only one who had a licence. But he said that when checked by fisheries at the ramp, it was his mate that got the infringment because he told them he caught one and his mate caught the other. So in this case it was the deckie with no licence who got the infringement.

 

Bit like the guy who wrote into the Sunday times, letters, last week i think?. Said he was pulled over by fisheries from a trip up north fishing with some of his mates. He had a licence but 2 his mates didnt. They had fished charter boats got a feed and were bringing some back. Apparently fisheries infringed the the driver, the only guy with the licence saying that because he had the only licence all the fish were his, so he had over his limit. I think this is a very grey area as my understanfding was that you dont require a RBFL to be of posession of fish once on land? From what this guy said happened to him and his mates, i hope common sense does prevail when he goes to court. 

 

Guess it all depends which Fisheries Officer you get and his/her interperataion of the law.

do you not think it is up to the skipper in his/her own boat to know what he/she can/cannot keep within legal licences? know i check my deckies are up to scratch when i have a decent day on the water, it is my boat.......

I'm a bit the same but I'm not going to insist on sighting their licence/s.  I would take their word if they said they had one, then it's up to them if they lied to you I reckon.  If they deliberately break the rules, then they should pay, not the skipper.  On the other hand, if the skipper doesn't ask and the deckie doesn't know the rules, then the deckie should cop it if they go over the limits.

I recently went crabbing in the boat with someone who thought they had a licence.  Turns out she had an RST not an RFBL.  She insisted that we were still allowed to catch 20 because that's what the boat limit is.  10 per person - 20 per boat.  I tried to explain that we could only keep 10 because it is still 10 per person, per licence with a "maximum" of 20 per boat.  We only ended up with 8 anyways but I wonder how many other people don't understand the rules?  Apparently she has been out a few times before hand with a friend who has an RFBL and they have taken 20 most times???  I think there would be a few people out there that think they are doing the right thing.

Lot of mixed storys there, there should be just one interpretation - Department of Fisheries ..... not whoever is on duty on the day

 

And just remember, like the police ..... do NOT piss them off if you get pulled up ;)

Its also abit of a worry when you get a renewal notice but you have already renewed your licence (I got it earlier) to combine with the other licences.  I can just see it now; I'll get booked for no licence as they see the old number!

Pete the same thing happen to me, when renewing all the other licences eg rock lobster, abs etc etc. I thought I will renew my RFBL so it will be on the same card as there were only a couple of month before it was due to expire. They still sent me a reminder to pay as it had a different licence number to the amalgamated card. There is only one of me that lives at my address. So does that mean if I have two licences I can take two bag limits, If they are stupid enought and happy to take my money. Lol

Yep, excellent initiative by the WA government to absolutely confuse the shit the simplest of activities and to place infringements on persons who are not to blame.

Dont know about the rest of Australia's laws, but the rules outlining daily bag limits, catergorising of fish, overnight stays (on an island of course) bag limits and filleting at sea just gets a bit too confusing considering you can be penalised for it.

I too was confused, ended up with 3 different licence cards and 3 different renewal notice's.

What i did was waited and paid for all the one's i wanted at the same time, finaly i got the one card with all the catagories on it.

I still made sure I was cover'd for what i was fishing for.

I ask all people on my boat what licence they have and make sure they understand the bag limit's.

A  Superior Court judge has dismissed a lawsuit seeking to overturn a disqualification by officials from the Big Rock Blue Marlin Tournament last year.
 
The private boat Citation had weighed in a winning 883-pound blue marlin to nab first prize, which is a hefty $1.2 million. It was later discovered that a team member did not have the required fishing license, this catch was disqualified.
 
That left second place getter Carnivore of Cape Carteret, the winner for its 828.3-pound blue marlin. The team was given the cash prize of $999,453.
 
The third place went to second, giving Wet-N-Wild, a cheuqe of $275K for its 460-pound marlin.
 
The tournament's board of directors released a statement saying they were pleased with the court's decision.
